Privacy Policy

SCOPE. This Policy explains how ListingCred collects, uses, discloses, retains, and protects personal information through its websites, applications, customer and creator workflows, communications, transactions, and advertising services. It does not govern third-party services operating under their own policies.

1. Who We Are and Covered Services

ListingCred is operated by EK Enterprises, LLC, doing business as The Gig Agency. In this Policy, “Company,” “ListingCred,” “we,” “us,” and “our” refer to that company. “Services” means ListingCred websites, applications, creator coordination, marketing workflows, advertising, payment features, communications, and related offerings.

2. Information We Collect

Information you provide

  • Account and contact information, including name, email address, telephone number, company, brokerage, role, username, credentials, and account preferences.
  • Transaction and order information, including packages, listing address, campaign details, receipts, refunds, and payment status. Payment-card, bank-account, Social Security number, and tax-form information are collected directly by Stripe and are not stored in ListingCred’s database.
  • Listing and project information, including property facts, public listing details, images, videos, access instructions, schedules, briefs, approvals, feedback, releases, and communications.
  • Creator information, including profiles, service areas, work samples, availability, assignment history, compensation status, and performance or quality records. Payout and tax details are provided directly to Stripe.
  • Content and communications, including uploaded media, messages, support requests, survey responses, ratings, reviews, and information you otherwise choose to provide.

Information collected automatically

  • Device, browser, operating system, IP address, approximate location derived from IP, identifiers, referring pages, and application version.
  • Usage and diagnostic data, including pages viewed, clicks, sessions, features used, errors, timestamps, and interactions with communications.
  • Cookie, software-development-kit, and similar technology data used for authentication, security, preferences, core functionality, and service analytics.

Information from other sources

We may receive information from brokerages, real estate professionals, creators, public property or licensing records, social platforms, Stripe, service and security providers, referral partners, and users who direct us to a listing or project.

3. How We Use Information

We use personal information to:

  • provide, personalize, administer, secure, troubleshoot, and improve the Services;
  • create accounts and coordinate creators, visits, approvals, content delivery, advertising, support, payments, and records;
  • verify authority, identity, eligibility, listing details, account access, and compliance where appropriate;
  • communicate about projects, transactions, service updates, security, policy changes, support, and marketing with consent where required;
  • measure service traffic, campaign delivery, attribution, product performance, and audience engagement without cross-context behavioral advertising;
  • operate ratings and quality controls, including assignment review and creator support;
  • screen project content and instructions for potential fair-housing, discriminatory, intellectual-property, safety, fraud, and platform-compliance concerns;
  • enforce contracts, protect rights and safety, comply with law, respond to lawful requests, and establish or defend claims; and
  • create aggregated or deidentified information not reasonably capable of identifying an individual.

4. Ratings, Reviews, and Quality Scores

Customers and creators may rate or review aspects of a completed project. Individual counterpart ratings are not revealed to the other participant before both sides submit or the applicable review period closes. ListingCred may calculate aggregate ratings and internal quality indicators from reviews, assignment history, completion records, support activity, and documented compliance or quality issues.

Authorized operations personnel may view these records. They may inform creator coaching, assignment eligibility, matching, investigation, or account review. ListingCred does not use a rating or quality score to make a solely automated decision that produces legal or similarly significant effects. Meaningful human review applies before a material restriction or suspension based on quality information. A creator may request an explanation, correction of inaccurate source information, or human reconsideration by emailing legal@listingcred.com with the subject line “Quality Score Review.”

5. AI and Automated Processing

ListingCred does not use customer-supplied listing content, private customer or creator data, messages, or project deliverables to train a generalized artificial-intelligence model without express consent. Service providers may process content using automated tools only to provide contracted functions on our instructions and subject to their agreements.

We may use automation to organize information, detect fraud or prohibited content, assist matching, flag compliance concerns, or support quality review. These tools support operational personnel; ListingCred does not make solely automated decisions that produce legal or similarly significant effects about an individual.

6. How We Disclose Information

We may disclose personal information to the following recipients for the purposes described in this Policy:

  • service providers and contractors supporting hosting, databases, authentication, payments, communications, support, analytics, security, media production, and business operations;
  • customers, creators, brokerages, property representatives, and project collaborators as needed to coordinate a project, visit, approval, payment, or campaign;
  • social-media and advertising platforms when we place or administer a customer-requested campaign; those platforms process information under their own policies;
  • professional advisers, insurers, auditors, regulators, courts, law enforcement, and other parties when reasonably necessary for legal, safety, compliance, and claims purposes;
  • a buyer, investor, lender, successor, or adviser in a financing, merger, acquisition, restructuring, bankruptcy, or business transfer, subject to appropriate protections; and
  • other parties when you direct us, consent, or intentionally make information public.

A current list of material subprocessors, including their function and processing location where available, may be requested at legal@listingcred.com. Stripe independently collects and processes payment, payout, bank, identity-verification, and tax information under its own terms and privacy policy.

7. Sale, Sharing, and Targeted Advertising

ListingCred does not sell personal information for money or other valuable consideration. ListingCred also does not “share” personal information for cross-context behavioral advertising, use retargeting technologies, activate customer lists for advertising audiences, or process personal information for targeted advertising as those terms are defined by applicable U.S. state privacy laws.

We may use service providers for limited first-party analytics, security, and campaign measurement under contractual restrictions. We do not authorize those providers to use ListingCred data for their own cross-context behavioral advertising. Because ListingCred does not presently sell or share personal information, a sale-or-sharing opt-out is not currently necessary. If these practices change, we will update this Policy and provide required notices and controls before the change applies. We do not knowingly sell or share personal information of individuals under 16.

8. Cookies and Similar Technologies

We and our service providers may use essential cookies and similar technologies for authentication, security, load balancing, preferences, transactions, diagnostics, and first-party service analytics. ListingCred does not use these technologies for cross-context behavioral advertising or retargeting. Browser controls may block cookies, but some features may not function properly. Where legally required, we request consent before using nonessential technologies.

9. Housing-Advertising and Content Compliance

ListingCred does not use protected characteristics to determine who may receive information about a housing opportunity. Housing campaigns must follow applicable fair-housing laws and platform restrictions. We prohibit sensitive personal information, discriminatory targeting, exclusions, steering, coded preferences, and proxy audiences.

ListingCred may use automated and human review to screen listing content, instructions, and campaign configurations for potential fair-housing or platform-compliance concerns. Screening may flag, restrict, or route a matter for review, but it does not replace the customer’s legal responsibility. We may retain or disclose relevant campaign records when reasonably necessary to investigate or demonstrate compliance.

10. Property Access and Entry Information

Property access instructions may include appointment details, entry procedures, contact information, and, only when necessary, temporary lockbox or access information. Access is limited to personnel and assigned creators who need it for the scheduled visit. Users should provide the least sensitive information necessary and should not place permanent alarm credentials or unrelated household security information in ListingCred.

ListingCred deletes property entry codes and comparable access instructions from active systems within seven days after the scheduled creator visit, unless a shorter period is operationally feasible or retention is required for an active safety, fraud, dispute, or legal matter. Customers should rotate temporary codes promptly after the visit.

11. Retention Schedule

The periods below are general targets and may be extended when reasonably necessary for a legal hold, dispute, security investigation, contractual obligation, backup cycle, or law. We delete or deidentify information when it is no longer reasonably needed.

12. Security and Incident Notification

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls appropriate to the sensitivity of the data. No system or transmission method is completely secure, and we cannot guarantee absolute security. Users are responsible for protecting account credentials and promptly reporting suspected unauthorized access.

If a data incident requires notification, we will notify affected individuals, regulators, or other parties in the manner and within the time required by applicable law.

13. Authorized Agents, API Access, and Connected Tools

You may choose to authorize a third-party application, automated agent, API client, or compatible tool to access or act on your ListingCred account. The tool may receive information and perform actions within the permissions you grant. You are responsible for selecting trusted tools, reviewing requested scopes, protecting delegated tokens, and revoking access when it is no longer needed.

ListingCred’s handling of account data remains governed by this Policy. A third-party tool’s independent collection, storage, use, or disclosure is governed by that provider’s privacy policy and terms. ListingCred is not responsible for a third party’s independent practices.

14. Your Choices

  • Account information: update available account settings or email legal@listingcred.com.
  • Promotional email: use the unsubscribe link. Transactional, safety, legal, and project messages may continue.
  • SMS: if you separately opt in, message and data rates may apply. Consent to marketing texts is not a condition of purchase. You may revoke consent using any reasonable method provided, including replying STOP when supported.
  • Connected tools: revoke agent, API, or third-party access through available settings or contact us.
  • Content and permissions: do not upload personal information, images, or recordings unless you have authority and appropriate consent.

15. U.S. State Privacy Rights

We extend the following request options to U.S. users, subject to reasonable identity verification and lawful exceptions: access or confirmation; a portable copy where feasible; correction; deletion; and appeal of a denied request where applicable. We will not discriminate against you for exercising a privacy right.

Submit a request to legal@listingcred.com with the subject line “Privacy Request.” Describe the request and identify the account or relationship involved. An authorized agent may submit a request where permitted, but we may require proof of authorization and direct verification. We generally respond within 45 days and may extend the period when permitted after providing notice. If a different statutory deadline applies, we will follow it. Appeals should be emailed with the subject line “Privacy Appeal.”

16. California Notice at Collection

During the preceding 12 months, we may have collected identifiers; customer records; commercial information; internet or electronic activity; approximate geolocation; audio, visual, or similar content; professional information; and inferences derived from ratings, activity, or preferences. Sources include users and their organizations, devices, service providers, social platforms, public records, and project collaborators.

We use and disclose these categories for the purposes described in Sections 3 through 6. We do not use sensitive personal information to infer characteristics beyond legally permitted purposes. We do not sell personal information or share it for cross-context behavioral advertising. California residents may exercise applicable rights through Section 15.

17. Nevada Privacy Notice

Nevada residents may submit a verified request directing us not to make a sale of covered information by emailing legal@listingcred.com with the subject line “Nevada Opt-Out Request.” ListingCred does not presently sell covered information as “sale” is defined by Nevada law. We will respond within the period required by Nevada law.

18. Children and Minors

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13. ListingCred also does not knowingly sell or share personal information of individuals under 16.

A customer or creator may not intentionally identify, record, upload, or publish a minor through the Services unless an authorized parent or guardian has provided appropriate permission and any required appearance or model release, and the use is lawful. ListingCred may request evidence of permission, restrict the content, or remove it when authorization is unclear.

19. Third-Party Services and Links

The Services may link to or integrate with third-party services, including social networks, Stripe, and user-authorized tools. Their independent privacy practices are governed by their own policies. Review those policies before providing information or connecting an account.

20. International Availability

The Services are operated from the United States and are not offered or intentionally directed to individuals in the European Economic Area, United Kingdom, or Switzerland. Do not use the Services from those jurisdictions. Information may be processed in the United States and other locations where our providers operate, subject to applicable U.S. law and contractual safeguards.

21. Changes to This Policy

We may update this Policy to reflect changes in law, technology, or our practices. The effective date above identifies the current version. For a material change, we will provide notice through the Services or by email to the account address when required or reasonably appropriate. Earlier versions may be requested at legal@listingcred.com.
